Choice Hotels Sweepstakes (the "Sweepstakes") is sponsored by
Caribbean Travel + Life magazine, a publication of Bonnier Corporation ("Sponsor").
ONE (1) GRAND PRIZE: Four (4) nights accommodations for two (2) at a Choice
Hotels® Caribbean property, selected by Choice Hotels International Services
Corp. in its sole discretion, $1,000 to use towards round-trip coach class air
tickets, welcome cocktail upon arrival, round-trip airport transfers, free
continental breakfast. Potential winner must give Choice Hotels International
Services Corp. at least thirty (30) days advance notice of preferred travel
dates. Approximate retail value ("ARV") of Grand Prize: $2,000.
Actual value may vary. Winner will not receive the difference between
actual and ARV. Trip subject to availability, blackouts and change. All
expenses and incidental travel costs not expressly stated above, including but
not limited to, airfare, meals (including gratuities), personal charges at
lodging, security fees, taxes or other expenses or incidentals are the
responsibility solely of the winner. No prize substitution or transfer is
permitted, except that Sponsor reserves the right to substitute a prize of
equal or greater value if the prize should become available for any reason. All
taxes and any other incidental expenses on Prizes not expressly stated above
are the sole responsibility of the winner.
SWEEPSTAKES TERM: The Sweepstakes begins on September 1, 2009 at 12:01 a.m.
Eastern Standard Time ("EST") and ends at 11:59 p.m. EST on November 30, 2009
("Sweepstakes Term"). The Sponsor's
computer is the official time keeping device for this Sweepstakes.
All federal, state and local laws and regulations apply; void where
prohibited. Odds of winning depend upon the number of eligible entries received
during the Sweepstakes Term.
ELIGIBILITY: The Sweepstakes is
open only to individuals, 18 years or older at time of entry, who are legal
residents of the
States
Hotels International Services Corp., Choice Hotels International franchises and
their respective parent companies, subsidiaries or agents, their immediate
families (defined as parents, children, siblings, spouse and grandparents), and
those domiciled with any of the foregoing are not eligible for the Sweepstakes.
Participation constitutes entrant's full and unconditional agreement to these
Official Rules and Sponsor's decisions, which are final and binding in all
matters related to the Sweepstakes. Winning a prize is contingent upon
fulfilling all requirements set forth herein.
TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. To enter, visit our website at www.caribbeantravelmag.com/contests
and follow the links to the sweepstakes entry page and complete the online
entry form in its entirety, including submitting your full name, address, phone
number and email and ensure that all information provided is complete,
true and accurate (the "Entry"). Entries must be received during the
Sweepstakes Term; entries received after the conclusion of the Sweepstakes Term
will be deemed ineligible to win. All submitted Entries become the property of
Sponsor and will not be acknowledged or returned; Sponsor is not responsible
for lost, late, inaccurate, incomplete, damaged, illegible, or misdirected
entries. LIMIT: Entry is limited to one (1) entry per household. No photocopied
or mechanically reproduced entries will be accepted. Online entries will be
deemed submitted by the authorized account holder of the e-mail address
submitted at time of entry. The
authorized account holder is the person to whom the applicable internet service
provider or other organization (such as a business or educational institution)
has assigned the e-mail address.<!--[endif]-->
WINNER SELECTION: On or about December 15, 2009, Sponsor will select one (1)
potential winner by random drawing from among all eligible Entries received
during the Sweepstakes Term. Potential winners will be notified by e-mail on or
about December 15, 2009. Potential winners will be required to sign and return
a sworn Affidavit of Eligibility and Liability and Publicity Release, where not
prohibited by law. If required documentation is not returned within seven (7)
business days of notification, if notification is returned as undeliverable, or
if a potential winner is disqualified for any reason, the applicable prize will
be forfeited and an alternate winner will be selected by random drawing from
among all eligible Entries received during the Sweepstakes Term.<!--[endif]-->
PRIZE AWARDS: Prizes will be awarded within sixty (60) days after winner
verification.
GENERAL RULES & LIMITATIONS: Except where prohibited by law, entry and
acceptance of prize constitutes permission to use each winner's name, prize
won, hometown and likeness for print publication, online posting, and any other
promotional purposes in any media, worldwide, without further compensation. By participating
in the Sweepstakes, you agree to release Sponsor and Choice Hotels
International Services Corp. and their respective parent companies, affiliates,
subsidiaries, franchises, employees, directors, officers, and agents from any
and all liability, claims or actions of any kind whatsoever for injuries,
damages or losses to persons and property which may be sustained in connection
with the receipt, ownership, possession, use, or misuse of any prize. Sponsor
is not responsible for technical, hardware or software failures, or other
errors or problems which may occur in connection with the Sweepstakes, whether
computer, network, technical, mechanical, typographical, printing, human or
otherwise, including, without limitation, errors or problems which may occur in
connection with the administration of the Sweepstakes, the processing of
entries, the announcement of the prizes, in any Sweepstakes-related materials,
or that may limit prize fulfillment or a participant's ability to enter the
Sweepstakes. Sponsor reserves the right to permanently disqualify from the
Sweepstakes any person it believes has intentionally violated these official
rules. As permitted by law and in accordance with the Sponsor's Privacy Policy,
Sponsor may use information provided by entrants to send announcements about
the Sponsor's products and programs via electronic and ordinary mail.
DISPUTE RESOLUTION: Except where prohibited by law, by entering you agree
that: (i) all issues and questions concerning the interpretation, validity, and
enforceability of these Official Rules, or the rights and obligations of
participants and Sponsor and its agents shall be governed by and construed
exclusively in accordance with the laws of the State of New York, without
regard to its rules on conflicts of law; (ii) any action at law or in equity
arising out of or relating to this Sweepstakes, or awarding of the prizes,
shall be filed only in the state or federal courts located in the State of New
York, and entrant hereby consents and submits to the personal jurisdiction of
such courts for the purposes of litigating any such action; (iii) any and all
disputes, claims, and causes of action arising out of or connected with this
Sweepstakes, or awarding of the prizes, shall be resolved individually, without
resort to any form of class action; (iv) any and all claims, judgments and
awards shall be limited to actual out-of-pocket costs incurred, including costs
associated with participating in this Sweepstakes but in no event attorneys'
fees; and (iv) you hereby waive all rights to claim punitive, incidental and
consequential damages and any other damages, other than for actual
out-of-pocket expenses, and any and all rights to have damages multiplied or
otherwise increased.
